Experience

David is an experienced litigator, wage and hour expert and published author. His practice has placed him at the forefront of the rapidly changing areas of employment law, particularly wage and hour class action litigation. Clients turn to him to help sort through issues like wage payment law, exempt/non-exempt status, shifting burdens related to employee meals and rest breaks, and defining reasonable accommodations for disabled employees.

As a result, David appears regularly throughout California trying civil matters in both state and federal courts and before the Department of Labor and Division of Labor Standards Enforcement.  His work on civil discovery matters, first amendment and technology and other thought leadership has been published in law journals, including the Hastings Communications and Entertainment Law Journal.

David’s litigation practice currently emphasizes the representation of national employers and local public agencies in labor and employment litigation, which includes labor advice and representation in labor arbitrations and administrative matters.  He is the resident expert on emerging and pending employment statutes at Foster Employment Law.

David is admitted to practice in the United States Supreme Court, the Supreme Court of California and the U.S. District Court, Northern and Eastern Districts, California; and the U.S. 9th Circuit Court of Appeals.
